Hi All,
My previous I-140 was denied due to the ability to pay issue since company was in loss and Idid not get prevailing wage since PD.I have appealed it hoping I can extend my h1 beyond 6th year.Is it true?
Also, Now we have pre approved labor with lower in same company where I can satisfy by showing W-2 to prove the ability to pay. Now If I am planning to apply another I-140 with labor sub,
would it matter to the new I-140 appllication if the previous I-140 was denied and is being currently appealed? Because in the I-140 form there is a question ,
"Has any Immigrant visa petition been filed by or on this person?"
Should I say "YES", Right? and also give the detail of previous filing????
Also How does USCIS verify the W2?BY contacting the IRS or ?
Please suggest?

EB 3 India..PD 03/24/2006. EAD approved-10/28/07; AP-01/09 , also same for the derivatives too..I-140 approved 09/13/2007, Also FP done..in OCT.

If you are on speaking terms, and she is in USA, then consider extending an olive branch to her. You can always extend the olive branch after you get a receipt notice for your I485.
I think that she can file as a dependant separately, using your receipt notice, so you don't have to decide before filing. It would be unusual, but I think possible. That approach may have several advantages.

Dear All,
I saw your website & thought may be you guys can help me solving my query about H1 transfer. I am holding a H1B valid till 2009. A month back a new company had filed a H1 transfer & I started working for them. Now I have 2 paystubs from this new company & I am getting a very good offer from another company & I would like to go for this offer. So my question is on the basis of these two recent paystubs can I get my visa transferred to the 3rd company while another visa transfer is in progress?

Hi guys,
I have the following clarification:
Earlier, I was working with Employer A and came to US after getting H1-B stamped.
Subsequently, my spouse has got her H4 visa stamped.
So, both of our visas are valid till 30th Sept 2007. My wife joined me in December 2005.
Then I changed my employer in April 2006, where I got my I-129 approved from Employer B.
In the meantime, my wife/spouse went to India in April 2006 & came back to US using old visa on July 15th 2006.
At port of Entry she got I-94 valid till 30th Sept 2007 (validity date of the old visa A)
I never got her I-94/H4 using the new I-129 from Employer B (Current Employer).
On July 3rd, I submitted my I-485 AOS for both of us.
I have the following question:
1. Is her I-94 still valid based on the old visa ?
2. Will there be any issues for not filing for H4 visa till now, even though I am planning to
apply right away as her I-94 is getting expired on 30th Sept 2007.
3. Is she out of Status as I left the old employer more than 180 days ago.

As stated above, interim EAD is not anymore issued at local center. What you can do after 90 days has lapsed, schedule an infopass appointment and then ask to expedite your EAD. In most cases, it doesn't exceed 90 days. A few unlucky one's had it in about 110 days!

i have birth certificate which is taken in 2005 but I was born in 1974
some of my friends are saying...as you are born in 1974 and as your
birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
to get the green card.
Is it right?
They are saying me to get Affidivits + non availability certificate now.
will it be a problem if I put my birth certificate....while applying for 485

c. U.S. resident alien (based on days present in the United States)

I guess your H4 is not approved yet and continuing your employment on H1B. Your best course of action would be to have your employer file an extension (beyond 6 years) for H1B and get a 3-year approval (with approved I-140). You can change jobs after this but if you don't want to take this path you can still find a new employer before end of march and apply for H1B to get a 3-Year H1B. You will need to restart your PERM and go through the whole process with your new employer ASAP.

Only one good thing I can see on PBEC efficieny is atleast they are processing cases from Nov 04. Which is really really a good news based on the pace they were at last year same time.

My company just received a latter titled as "Confirmation of Withdrawal" which states that your Labor Processing Application filed in November xx, 2004 is withdrawn, as requested by your letter dated August xx, 2004.
Isn't that amazing that they are so swamped and desperate in eliminating the backlog that they do not know the chronological order of the dates also?
Backlog Elimination Centers' are the biggest waste of Taxpayers Money, I think.

Never seen any one asked for EVL for derivative at POE. Especially on AP. So you should be fine on that front. But You need to realize that you need to find a same / similar employment ASAP.

Nikon was most popular among the pros photographers during the 1970s and that finding has led me to choose it for my 35mm equipment.
One of the major advantage is its system ability to use old lenses for its newer bodies. Moreover accessories for the camera bodies are easily available in the local photo retail outlets.
The lesson learned from the D2h could have gone into the making of the D70 along side with their surprise attempt in the huge advertising spending (TV and other various media) in launching the product.
Perhaps it could have been a shortsighted affair to aim the D2h only for the PJs. Nikon could have been holding the flag up when the camera could be in the hands of millions of advanced serious amateurs including the many part-time professional photographers world-wide. Not to say the huge market in China could have been overlooked by their thinking engineers!
What about the millions of part-time and full time photographers doing weddings and other assignments who would wish that the D2h is an 8 MPs. where large enlargements are required.
The D70 has brought many loyal consumers to stop discarding the old Nikon lenses. In fact their current aggressive marketing attitude has seemingly brought a smile back to many previous happy Nikon users.
My next wish is for Nikon to design and produce another DSLR by carefully listening to users of their equipment. Not to say that just by assumming that all PJs only need is 4 MPs is wrong because that can be a decoy in their planning too. More to watch from the factory that was set up to produce the D70 in Thailand! I am sure Nikon will not disappoint DSLR users with many more surprises in the very future.
